REQUEST FOR OF INTEREST FOR PROCUREMENT FOR CONSULTING SERVICES FOR THE

TECHNICAL ASSISTANCE ON THE ESTABLISHMENT OF THE RULES ON RETAIL AGGREGATION (2nd Bidding)

1. The Energy Regulatory Commission (ERC), through the Government of the Philippines (GoP) Appropriation for Fiscal Year 2021, intends to apply the sum of One Million Five Hundred Thousand Pesos PhP1,500,000.00), inclusive of all government taxes and other charges and fees, being the Approved Budget for the Contract (ABC) to payments under the contract for Consulting Services for the Technical Assistance on the Establishment of the Rules on Retail Aggregation (2nd Bidding), (Lot No. 2021-22). Bids received in excess of the ABC shall be automatically rejected at the opening of the financial proposals.

2. The ERC now calls for the submission of eligibility documents for Consulting Services for the Technical Assistance on the Establishment of the Rules on Retail Aggregation (2nd Bidding). Eligibility documents of interested consultants must be duly received by the BAC Secretariat on or before 4 May 2021 at 12:00 P.M.

at 8th Floor, Pacific Center Building, 33 San Miguel Avenue, Pasig City. Applications for eligibility will be valuated d on a non-discretionary “pass/fail” criterion. Prospective bidders are requested to bring the

originals of the documents submitted and present the same for comparison during the opening of the eligibility documents.

3. Interested bidders may obtain further information from BAC Secretariat and inspect the Bidding Documents at the address given below during Monday to Friday, 9:00 A.M. to 4:00 P.M.

4. A complete set of Bidding Documents may be acquired by interested Bidders on 26 April 2021 from the address below and upon payment of a non-refundable fee of Five Thousand Pesos (PhP5,000.00).

It may also be downloaded free of charge from the website of the Philippine Government Electronic Procurement System (PhilGEPS) and the website of the Procuring Entity, provided that Bidders shall pay the

applicable fee for the Bidding Documents not later than the submission of their bids.

5. The BAC shall draw up the short list of consultants from those who have submitted of Interest, including the eligibility documents, and have been determined as eligible in accordance with the provisions of

Republic Act 9184 (RA 9184), otherwise known as the “Government

IRR). The short list shall consist of five (5) prospective bidders who will be end to submit bids. The criteria and rating system for short listing are:

Note: only the top five (5) ranked consultancy firms with at least

70% rating d on the short listing criteria will be invited to

submit the Technical and Financial Proposals.

6. Bidding will be conducted through open competitive bidding procedures using non-discretionary “pass/fail” criterion as specified in the IRR of RA 9184.

Bidding is restricted to Filipino citizens/sole proprietorships, cooperatives, and partnerships or organizations with at least sixty percent (60%) interest or outstanding capital stock belonging to citizens of the Philippines.

7. The Procuring Entity shall evaluate bids using the Quality d Evaluation (QBE). The criteria and rating system for the evaluation of bids shall be provided in the Instructions to Bidders.

8. The contract shall be completed within six (6) months, commencing from the date of the Notice to Proceed (NTP) to the winning bidder.

9. The ERC reserves the right to reject any and all bids, declare a failure of bidding, or not award the contract at any time prior to contract award in accordance with Section 41 of RA 9184 and its IRR, without thereby incurring any liability to the affected bidder or bidders.
